1. Statutory Compliance Overview (PAIA Section 51 & POPIA)
This Promotion of Access to Information Act (PAIA, Act 2 of 2000) Section 51 Manual summary sets out the statutory procedure for requesting access to records held by Dr Bongeka Khumalo Chiropractic Practice (AHPCSA Reg. No. A12499 · BHF Practice No. 1029355) as a private healthcare body in the Republic of South Africa, balanced against our statutory duty to protect patient health confidentiality under POPIA and the National Health Act.

4. How to Request Access to Medical or Personal Records (PAIA Form 2 Procedure)
While patients under active care may request a clinical summary or referral letter directly during consultation, formal statutory requests for copies of complete clinical records — or any request submitted by a third party, insurer, or legal representative — must be submitted on the prescribed PAIA Form 2 ('Request for Access to Record' under the PAIA Regulations) addressed to the Information Officer at drbongekakhumalo@gmail.com.
Every Form 2 request must be accompanied by: (a) a certified copy of the requester's South African ID or passport; (b) where a third party acts on behalf of a patient, a signed power of attorney and explicit written patient consent authorising release of Special Personal Information under POPIA Section 32 and PAIA Section 63; (c) sufficient particulars of the records and consultation dates requested; and (d) payment of prescribed statutory access/reproduction fees where applicable.
5. Mandatory Protection of Patient Confidentiality & South African Patients' Rights Charter
In terms of Section 63 of PAIA and Sections 14 to 17 of the National Health Act (Act 61 of 2003), the Information Officer must refuse a third-party request for patient health records unless written informed consent from the patient is provided or disclosure is mandated by a South African court order or statute.
Dr Bongeka Khumalo Chiropractic Practice upholds the South African National Department of Health Patients' Rights Charter — affirming every patient's right to a safe clinical environment, participation in healthcare decisions, informed consent, refusal of treatment, confidentiality and privacy, continuity of care, and the right to raise clinical or ethical concerns with the Practice or the Allied Health Professions Council of South Africa (AHPCSA) or the Information Regulator (PAIAComplaints@inforegulator.org.za).
